My question involves unemployment benefits for the state of: New Jersey. I understand that in August 2008, the N.J. Apellate Court ruled that an employer must wait five days before terminating an employee for the casue job abandonement. In order for UI to determine you "abandoned" your job and thus deny benefits, the employer must ahve waited five days. My employer claimed I abandoned my job at the end of my FMLA and canned me the very next day. It's in writing too. However, two different employee manuals stipulate five days must ahve passed before any disciplinary action can be taken. The first offense for violating this rule is a five day suspension - I got fired??? No charges were made against me either per union contract.
