    Default Are Reciprocal Recordings Necessary

    In the state of NY:

    Does a ROW need to be recorded on both the servient and dominant deeds? What would be the situation if the easement was only recorded on the dominant deed and not the servient deed?

    if there was nothing to support the inclusion of such a ROW, the grantor would be liable for misrepresenting the property to the grantee. You cannot simply write in a ROW unless the servient tenant grants the ROW or it is made by some other documentation.
