My question involves a consumer law issue in the State of: Washington
Here is what happened:
I posted tickets for friend on our work 'ticket distribution list.' A girl indicated via email she wanted to buy them. She brought me a check and I emailed her the tickets. Three days later she came to me and said she didn't think she could go and could i try to resell them. I said I will try but I didn't think I could because there were so many for sale and it was last minute. I posted the tickets again. That night she emailed me asking if the tickets had sold and I told her no. She never returned or offered to return the tickets. The tickets did not end up selling at all so I cashed her check.
3 weeks later she emailed me asking why I cashed her check because she returned the tickets saying she couldn't go.
I don't believe I owe her money as she clearly indicated she was still somewhat responsible for them by asking if i'd found a buyer...she bought them from me and never returned them so in essence she has ownership of them.
My question is do I legally need to give her money back?
