Whatever happened to Jury Nullification? Is this still used? Still legal?
Whatever happened to Jury Nullification? Is this still used? Still legal?
As the Talking Heads might say, it's the same as it ever was.

As far to other points of your question.
Jury Nullification was to powerful of a tool for the people to possess so it has been hidden from the view of the public. The people have no need to be a part of government other then from the view of a spectator. We as a society have moved more towards a (in ideal) Aristocracy (Platonic) from of government, or (in truth) an Oligarchy. Though the two different types are not far apart.
I still don't understand how it works. In the case of a mandatory sentence say the black kid who got 10 years for teenage sex. The jury knew there was was a miscarriage of justice in process but according to the weight of the evidence they had no choice but find him guilty.
If they all decided to find him innocent anyway because the sentence was so harsh is that jury nullification and are the jurors protected?
