Back in California in 1998 I was convicted of having a consensual sexual relations with a girl 3 yrs younger than me. I never touched the girl in that way or any other way for that matter. Long story short I ended up pleading NO CONTEST to a Felony 261.5(c) California Penal Code. This is why. I was home sleeping at the time she said this happened, I had no witness or alibi, plus the DA said there was a witness that saw her and I together that night and was willing to take the stand (to commit perjury none the less). I passed a stress-analyzer (other method of lie detection & ploy-graph) but it was considered circumstantial and was only used for obtaining the arrest warrant, it had no basis in the case itself. I had a paid attorney and he even said sex cases are some of the most hardest to beat. But i wasn't being charged for rape or anything. Just some stupid girl "saying" we had consensual sex.

The DA in my county (at the time) was an a$$ and would make 18yr guys register as a sex offender if they had sexual relations with girlfriend who was 17 even if the had been dating through high school. A little hard if you ask me.

So the deal was plead No Contest for a Felony. Serve 60 days in county jail then after completing 3 years of probation it could be reduced to a misdemeanor if I had no other incursions with the law or violated my probation. Expunging this record was not an option at that time.

Some background about me:
At the time before I was convicted I had recently graduated from the local Police Academy. I was also enrolled in the Advance Officers Training Academy which was to start that fall.


The Present:
I am now married and have 2 daughters & live in Texas. I have 2 black belts in mixed martial arts and help teach self defense to battered & abused women. I have been treated like scum and at times was fearful of having officers "plant items"...but I have kept moving on and have not gave up the love of law enforcement. Also I have not had any dealing with law enforcement (arrest, court, convictions, etc) since.

In January 2009 my Felony will be reduced to a Misdemeanor and then expunged for the state of California. Is there a possibility of pursuing a career in Law Enforcement (Police Officer, Sheriff Deputy, Extradition Agent) in the State of Texas?
