    Default What State To File for Overtime Wages

    My question involves employment and labor law for the state of: AZ, FL and KS.

    I want to file for unpaid overtime wages. My company's home office is in KS, but I was physically working in AZ and FL building commercial buildings. I am terminated and now live in TX. Can I file in TX?

    No. If the wages were earned in AZ and FL, then that's where you file. The state of Texas has no jurisdiction over wages earned in other states.

    FL does not have a state DOL so you may want to consider filing with the US DOL.

    Thank you for your response. Question, does that mean I have to hire 2 attys in 2 different states??

    You don't have to hire an attorney at all. You don't need an attorney to go through the DOL.
