    Default Au Pair and J1 to H1 possibilty

    Hi, I would like to get some advices and valuable insights regarding changing visa status from J1 to H1 (a,b) working visa.
    I am an au pair, few months ago extended with my host family to stay for 1 more yr and now this is my 2nd yr in the states and now about 6 months away from the end date. My questions are:

    1) If I have relevant education and would like to find a job in the U.S, and if it happens that an employer is willing to sponsor me a H1 visa, is it possible to change my visa status from J1 (au pair) to H1 immediately and start the job. If possible, can it be done while in U.S or has to do in a 3rd country. What sort of timeline can one envision.

    2) What other options can one pursue. Thanks so much! Really appreciate it.

    Default J1 and HRR

    If you are subject to the 2-year home residency requirement, you will need to petition for a waiver of that requirement to be eligible to remain in the U.S. on another form of visa.

    Default About J1 extension

    My current J1 trainee visa with company will expire in two month and I want to transfer to F1 visa. Although I applied already for home residency waiver, I am afraid I am not able to get it in two month.
    1. Does the one month of pack-up time for J1 would be legal stay if I transfer to another visa? Do I need to apply for this one month pack-up time?
    2. Can I apply for F1 visa in waiting for that J1 home residency waiver? During that period, is that legal stay, or I should go home to wait?
    3. If school is willing to offer J1 for me, am I legal stay once I submit the J1 program transfer application?
    4. My current company is willing to extend my J1, but my program sponsor company claim that the program length setup is fixed, they do not do extension. What should I do in this case, can I complain to ECA?

    My case is complicated, and I really need help SOS. Thanks.
