    Default Deferred Program in Illinois

    My question involves criminal law for the state of: Illinois

    I was charged with a misdemeanor for retail theft. I went and got legal advice here at my college (I am 20) and was told by the campus attorney that he has seen many cases like mine and since I have nothing else on my criminal record that I would be a likely candidate for a deferred program. He described to me that if I do qualify, I will need to take a test and pass it before my court date. By passing it, he said that I would not need to go to court and it would not show up on any background checks. Also, he said that I could then get my arrest expunged afterwards, which would take 6-8 weeks.

    My main reason for posting is to see if anyone has any knowledge about this or if they have been in a deferred program. Also, I want to make sure what I just wrote is correct because I don't want to be mistaken. Any information will help, thanks!

    Sounds like a typical diversion program! Your getting the opportunity to make a really bad mistake go away. I hope you take full advantage of it and learn from your mistake. Some don't get this "luxury" as the programs aren't available everywhere. Future employers (and present for that matter) don't like to hire theifs....keep this in mind incase your fingers start to wander again.

    This campus Lawyer is familar with criminal law? Your going to ignore court on his suggestion!? I would make some calls to other Attorneys or even court before doing anything like not showing up to court

    He stated that if I do this program that I would not need to go to court as they want to focus their time on more serious misdemeanors. He is an attorney, has the knowledge of the McLean County court system, and apparently has been able to get others into this program who were in a similar situation as I am. He is available to make appointments specifically with college students (as he was hired by the university). However, I will make sure that if I am able to get this and complete it, to make a call over to the court.

    Thanks gigirle for your response as it actually is called a diversion program. I was able to research more about this and sounds exactly what he described.

    You missed my point! You need to verify not showing up to court being wrong will make matters much worse!

    It's not uncommon for University's to work with local courts. Its also frequently used for MIP's. So I'm sure that the campus lawyer is familiar with criminal law.
