    Default Missing Violation Code and Incorrect Posted MPH on NY Speeding Ticket

    My question involves a speeding ticket from the State of: New York

    I received a speeding ticket on a highway in New York City last night. When I got home, I realized the cop did not enter the violation code, and his notation in the "description/narrative" box is completely illegible. Also, he incorrectly noted the speed limit as 50 mph, while it is actually 55. I know the NYC Traffic Violations Bureau is notoriously difficult, but are any of these omissions sufficient grounds for a dismissal of the ticket?

    Although the officer did not enter the violation code, I would bet he circled the oval above 1180b or d instead. The illegible "description/narrative" box is a decent argument if it is truly illegible. Assuming this is a NYC case, the maximum speed limit is 50 (not 55) and therefore this would not be an error. If the ticket was issued elsewhere, you have a pretty good argument on this point.     Thank you for getting back to me. Incidentally, the officer did not circle the oval next to 1180, b or d. In fact, none of the bubbles is darkened. Also completely blank are the bubbles for TRINF and MISD, along with the row starting with NAV LAW. Does that make my case any stronger, or is NYC simply a lost cause for fighting speeding tickets? And while you are correct about the NYC highway speed limit being 50 and not 55, the description/narrative is truly illegible. I have been a teacher for 13 years, and while I can usually decipher any handwriting, I can barely make out a letter of what he wrote.

    You have a few issues to argue here so I would plead guilty and fight the ticket. I hope you win.
