    Default Roommate Issues

    My question involves a roommate in the State of: California

    i've been living in a place for a little over a year now, no lease (that im on). After a while i started getting weary that my roomate was renting my room out to me for more than it was suppose to be and helping himself cover his part of the rent. I asked to see the lease (supposedly in his name) but he refused to show me the lease. saying, it's not my business and that im not on it. (i write my rent checks to him btw). a few days later, i asked for the spare key to my room. i dont trust him, and i figure it be fair since i dont have a key to his room. again he refused me, and said that he was keeping at least one key to my room. what do i do?

    What, exactly, was your agreement with your roommate?

    That you'd split the rent in half, or that you'd be renting for $X/month? Do you have the agreement in writing?

    There's no law that says your landlord, who is renting an apartment, can't charge you more than half of the rent. There's no law that says your landlord has to give you every available key to your room. If you're not comfortable with the arrangement you have with your roommate/landlord, I suggest giving notice and finding a new place to live.

    there was no written agreement. when i was looking at the room for rent, i was told it was 600/mon. He is not the landlord. he is a tenant supposedly on a lease. is that called subleasing?

    OK. You agreed to that amount, so what's the problem?

    Sometimes. Sometimes it's just a roommate arrangement. Neither is illegal, and neither requires that the rent be split precisely 50/50.

    I concur with Mr. K. If you do not like the situation you agreed to, give your 30 day written notice that you're leaving, and find something that suits you better.

    When you sublease from the original tenant, the original tenant is your landlord for purposes of the sublease.

    grr, thats not what i wanted to hear, but kinda what i figured. guess i'll have to look for a new place. the double standard is killing me, he wont give me the spare key to my room, but he's got the nerve to lock his bedroom door in front of my face while he's in the shower. -vent-
