    Default It's My Fault, How Can I Fix It

    My question involves criminal law for the state of: Ill
    How can I help my boyfriend defend himself when I did'nt press the charges and the state want me to get a order of protection. He did'nt hurt me but I ended up with a cut above my eye and i was mad at the time because we were fighting so my big mouth was a running. He is on parole and i think that is why they put him in jail. Now how can i fix this? Some please help me with this

    When a crime is committed (like domestic violence), it is considered to be committed against ALL of us, against all of society, not just the victim. If victims were always needed to pursue a case, no murder would ever be prosecuted (hard for dead people to sign a statement I hear). It doesn't matter if you press charges or not, that's the job of the state and the responsibility of the prosecutor - not only on behalf you the victim in this case, but in the interests of the NEXT person he might want to slap around.

    What part of "cut above my eye" doesn't register to you as "hurt"?

    He is on parole and i think that is why they put him in jail.
    His parole status isn't going to help him, but it's likely NOT the reason he was arrested - instead, law enforcement determined that he was the aggressor and since you had obvious injury, they really didn't have any choice BUT to make the arrest - you can pretty much take it to the bank that when there is a domestic violence call and there's a scratch on someone, that means someone is going to jail. The days of police showing up and telling people to take a walk around the block to cool off are long over. Domestic violence cases are crimes, and a particular type of crime that is known to have a high rate of escalation (today it's a slap, tomorrow it's a stabbing or a shooting or a murder investigation).

    Now how can i fix this? Some please help me with this
    How can you fix it? Do you have a time machine where you can go back and sit there and take it and either not call the police or keep quiet enough that no one else hears the fighting and calls on your behalf? If the police documented that there was an injury, even "just" a cut, odds that the prosecution is just going to walk away are slim (especially since he has a prior criminal history). The best you can do at this point is either pony up the money for the best criminal defense attorney you can buy, and/or, get some help for yourself to figure out what dynamics are in play in your life that make it ok with you that he injure you. If he is convicted, he'll not only be looking at sentencing for THIS crime, but will likely have his parole violated and he'll get to serve whatever time he had remaining on the prior charge as well. The only thing you really have control over is where YOU go from here; his actions have put his own fate in the hands of "the system".
