My question involves a child custody case from the State of: New York. I am wondering if a father has rights to custody if he and the mother were never married. There is no question on paternity and he has been supporting both of them, but they have some difference and he is only staying because he doesn't want to lose his daughter. He was told by an attorney long ago that if he doesn't marry her he does not have custody rights only visitation, is this true? Thanks for your help.
