My question involves business law in the state of: New Mexico
Ok, First of all I just got diagnosed with bi-polar disorder so this question might be odd, but I am now feeling up to par to ask it.
I signed a no-compete and employee contract after I was relocated here by the company I work for. I dont want to type a book about the contract but it basicly says that I cant do business on my own in the same county for two years after the contract ends. and I have to work two years for the company, also that I have to pay them for lost profit if I quit within the two years, and plus pay attorney fees too.
They verbally agreed to provide insurance, and a trip to vegas, if I sign. I got rejected for both. I walked out because of them cussing at me one day and they said I am responsible for the $700 dollars they lost that day. Anyways WE apologized, and I am still working there. I could not afford an attorney so Legal aid helped me. I sent them the contract and they told me that everything on there is enforcible including the lost profit deal. I plan on honoring my part of the deal. But here is the question regarding the contract.
1. can they sue me if My wife starts a business in her name and I help her(she is not on the contact)?
2. can they sue me if I do business in another state (texas is just 3 miles away)
3. If I have my wifes customers sign a paper stating that they are not customers of the company I now work for.
Keep in mind that my employer and his attorney wrote the contract up without my input. and I was pressured into signing it , as I am gullable and bi-polar. also told them that I will sign for a $2500, plus medical insurance plus vegas trip which they did not do. plus they have the big lawyer and I dont
4. If they do sue me and win how enforcable is it , can they take me to jail if do business on my own. can they physically force me not to do business.
