    Default Overstayed My Visa Waiver and Want to Marry My US Citizen Boyfriend

    Hi


    Im 25 F UK Citizen , i came to the USA for the first time on november 29th 2007 on visa waiver to meet a guy that i had been talking to online , before my 90 days were up i went back to the UK for 2 weeks then i came back to the USA in March 2008 again on visa waiver and its now november 2008 and i didnt leave to go back to the UK and im thinking about getting married to my USA boyfriend .

    Questions, If we get married here , in USA , now

    1.Will i beable to obtain a USA social security number [residency] ?

    2. How long will it take and how much will it cost , before i can get a job in the USA and beable to go back to the UK and visit my parents and come back to the USA ?

    3. What is the process , is it something we can do on our on or do we need a lawyer ?

    1. If, after petitioning to adjust your status, you get employment authorization (EAD), you will be able to get a social security number.

    2. It will take as long as it takes. You can check current processing times here - but they're averages, not a promise that yours won't take longer. At present, if you leave before you get your Green Card you're looking at a three year period of ineligibility to return. Once you hit the one year mark for your overstay, that goes up to ten years. So you will want to stay in the U.S. while this process continues.

    3. The process, discussed in more detail in dozens if not hundreds of threads in this forum, is to get married then petition to adjust your status on the basis of marriage.
