    Default Can Children Be Adopted to Strangers when an Able Family Member is Willing

    My question involves child abuse or neglect in the State of: IL
    My sister has never been the best mother of my 3 nieces/nephew. About 2 years ago DCFS got involved along with a group called Kids Hope United and have since aggresively removed the children from our entire family. The kids have been in foster care for about a year and a half. WITH STRANGERS.They even ordered my brother in law to get a divorce from my sister or they threatened to take his rights. Bottom line they have completely seperated my sister from her husband, the children from the and us, and the children from eachother. Recently both parents' rights have been terminated, meanwhile my mother and I have stepped in to hopefully get the children. My question is can the state adopt the children out if we are in the picture? They are making it very hard for us to even get into the "sealed" files. Do we have rights to see/talk to them? No one from these organizations will even answer our calls. Can they really just take them out of my family? Can they really tell my sis and her husband they have to get a divorce? I can't believe this.

    You need to get a consult with a local attorney ASAP.

    Default We did

    We already have a lawyer working on the case. We have asked him all of these questions I just wanted to see a second opinion. Also it's been taking forever.

    Apparently, the state has determined that your sister's presence is so toxic to the children that anyone associated with her is assumed to be toxic as well.

    By the way, they can't force anyone to get a divorce. All they can do is say that this home/parent isn't appropriate for a child... and if you want to remain there/with him, you will lose your children.

    If they believe that the first thing you will do with the children is to take them to see sister, then you are absolutely going to have an uphill battle.

    Why was your sister declared unfit?
