    Default Looking at House Arrest Time

    My question involves criminal law for the state of: California.

    I was arrested for felony grand theft for shoplifting almost $8000 from my employer.
    My lawyer has met with the judge and DA, and they are not willing to drop to a misdeamenor. I have a 5 month old child and my lawyer told me that the judge and DA have agreed to not contest anything more than 6 months on the ankle bracelet system, and as long as I stay out of trouble for two years with the felony on my record I can go back and have it dropped to a misdeamenor. Then after a year I can try to get it erased. THis is my first time being in trouble. I know what I did was wrong..and I am a decent upstanding citizen with a college degree and all. I need someone to give me some advice on if this is something I should agree to. Also, when I go to see the probation department, who I guess are the people who make the suggestion of a sentence and time, how can I get them to give me as little time on the bracelet as possible? I have two roommates who do not know about the situation and would like to keep it out of their heads.

    Don't you think your roommates will realize that something is up when you haven't left the apartment in 6 months?

    As your attorney... but I would recommend you take the plea. for eight grand, you should be facing prison. In fact, I am a little hacked that you are not.

    After all, what time period were these thefts done over? This isn't accidental theft... this is a pattern.

    We live in a 4 bedroom house with me, my fiance and our 5 month old child, his two older children, our two roommates. Our house is full ALL THE TIME. Considering the fact that I was just pregnant for 9 months and really didn't, and still don't go out a lot, I am assuming that they will not notice that I am home a lot. You think this is unrealistic?
    I also plan on enrolling in school to get another BA, so I will be gone for that too.
    This happened over a period of a year. Yes, it WAS a pattern. I have been seeing a therapist and went through a type of pyshch exam for my lawyer.
    I have no previous criminal history at all.

    Also,
    what are the chances and how can I get them to let me still do things like go to the gym, go grocery shopping, enroll in additioanl college classes, etc...????
