My question involves a roommate in the State of: Oklahoma
I currently live in a 3 bedroom house with, at the moment, my one roommate, we will call Jenny. We orginally moved into the house in March, and had problems with our third roommate, we'll call Tina, immediately. All 3 of our names are on the lease. When we first moved in the 3 of us sat down and discussed how we would pay/divide up rent and utilities. The verbal agreement between the 3 of us was that we would split rent into 3rds by the bedroom, and utilities by the number of people in the house. This was because at the time Jenny's boyfriend was living with us, and while there were 4 people living in the house at the time, Jenny's bedroom is by far the smallest in the house so we decided it was a fair trade off.
I'll just skip through all the other stuff that Tina has pulled since we moved in and how much money she owed me at one point, to which I only collected from her after I threatened to sue her.
So, the latest problem is this. On the 1st of November Tina moved out. Completely randomly, she literally took all of her stuff, didn't say a word to me or Jenny and just left. So a week later I texted her, reminding her to send her rent in, because her name is still on the lease. She called me, claiming she talked to our landlord, told her how Jenny and I weren't following the rules of the lease, making it void, and that our landlord gave her permission to leave. So I've been franticly searching for a replacement roommate because Jenny and I absolotely cannot afford to cover her portion of rent, to no avail. But I spoke with my landlord today, and she demanded the last 3rd of the rent, stating that we're responsible for 100%, not just a portion of it, which is understandable. But my landlord also told me that evidently, Tina never actually spoke with her, she just mailed her a letter stating that to her, our lease was void, and that she was going to move out. My landlord also specificially said she never gave her permission to leave, and that her name is still on the lease. But my landlord has made it clear she wants nothing to do with this, so she won't be of much help, short of a written statement saying she never released Tina from the lease.
So now, I know I can sue her to recoup the money she owes me for the utility bills, also the money she owes from keeping Jenny and my deposits on the water and trash service (which were in her name when she shut off all service to the house), and the money that Jenny and I will have to scrape up to cover her rent for this month. But my biggest question is there any way to sue her for future rent? I know that may sound stupid but Jenny and I really like the house we're in, we don't want to get evicted, and have really tried hard to find another roommate and really can't afford to cover her part of the rent. So, what do I do?
