Recording and Defamation

Someone recorded a conversation with there boss, in the state of ohio, on private propety and in there office. Now he is trying to use these tapes and says there boss is raceist....Can you legally record people like this and can't you sue for defamation since he is telling people he is racist

In Ohio is is legal to tape a conversation as long as one party to the conversation is aware of the taping.

If he believes the boss is a racist, he is entitled to say so. That is his opinion and opinions are not defamatory.

What about the laws the privacy law...since it happened in an office? And since the employer didnt give permission?

There are no privacy laws that were violated. Its being in an office makes no difference - you have no legal expectation of privacy in an office except in the bathroom and any changing areas.

The employer may take action if he wishes but no laws were violated. The fact that the employer did not give permission does not make it illegal.
