My question involves criminal law for the state of: Illinois..
Me and my friend were passing threw Illinois going toward Indiana.. We passed a couple state police officers that were sitting in the median, and one of them pulled out behind us, got on to the side of us, then got behind us again, turned on there lights and pulled us over. I gave the officer my license, registration, and insurance. He said i did not have a license plate light, and when he was riding next to me i swerved a little across the fog line. He asked me to get out of the car and go back with him to his car. He was then asking me questions about what we were doing where we were going.. He then said my clothes smell like marijuana. He got out of his car went to my car and preformed a search, the passenger was told to step out of the car, he found a blunt with marijuana, and compressed weed in the console, about 7 grams. Then he asked the passenger whats in the trunk.. she said nothing.. he asked me i said nothing.. then he opend the trunk, and found 5 burlaps of cannabis, then he let his dog out of the car and smell the car..
I thought that when a officer opens some ones trunk they need to have a search warrent.. and i didnt see a reason for me to get out of the car if i had all my information. I didnt even get a ticket for the original traffic stop. If he didnt smell any marijuana when he pulld us over, was there any need for me to get out of the car?.![]()
