    Default My 16 Year Old Sister Wants to Live with Me

    I am 20 years old, I left home when I was 16 due to abuse within my home. My little sister is 16, will be 17 in January '09. Last year I called CPS and had her removed from the home. Our mother did parenting classes and participated with CPS, she therefore was able to take custody of my sister again. My sister is miserable. Calls me everyday crying. If I were to take her out of state, what rights would my mom have? If she reported her as a runaway, would they look out of state? Could I go to jail for "kidnapping". Any ideas on what I should do to help my little sister? Thank you.

    You have no "legal" rights to your sister. Unless Mom allows her to live with you it isnt likely going to happen. If there is still abuse in home then call CPS again

    i believe you may be able to take your mother to court for custody of your sister granted you exhibit evidence that she is not fit to take care of a child and that you can provide a healthier and safer environment, mentally physically,emotionally and financially. Although you may have trouble doin so if your mother has regained custody after going through cps's parenting classes. The fact of the matter is that your mother regained custody by following the standard procedure as required by cps.
    That being said it sounds in your post as though you want to remove your sister from your mothers custody without legal procedure bein followed. I believe that you going and taking your sister, for whatever reasons, is unlawful to do without either going through a custody battle or your mom giving her up for adoption. In which case you would have to apply for the ability to adopt her as your child. Besides that the only legal way i can tink of is for your sister to emancipate her self through the courts. Hypothetically speaking, if the court grants her emancipation request she is free to move with whomever she would like.
