    Default Child Support

    My question involves child support in the State of: Ohio
    My question is I currently owe child support and if I get married will my new partner will also be responsable for my child support payments?

    No. However, if you are unemployed, or under employed the court can take into consideration a spouse's income when determining if the NCP is in contempt and has the ability to pay or not.

    Your spouse's income cannot be included when a CS amount is determined or modified.

    If you file a joint return for your income tax, they will take the other persons half to put towards owed child support. Make sure that the other spouse files an injured spouse for so they can get their part of the return.

    In addition if you stop paying or get to far behind they can go after your joint checking account, and they do not care if the other persons money is in it.

    Thanks for the responses. My other question is that my fiancee is on SSDI will he be accountable for my child support since I'm currently not working when we get married.
