    Default Caught Shoplifting in a Target Store

    My question involves criminal law for the state of: Arizona

    Yesterday someone close to me was caught Shoplifting in Target, they were taking to an office where after a long wait the Police were call. As I sat and waitted a million thoughts ran through my head one was what will happen now.

    When my Loved one was released the officer escorted her out of the store, (this is her first offence) she was charged with shoplifting $130.00 worth of merchandise. The officer told her that she will have to serve 6 months of jail time.

    What I want to know if this is true and what will happen if she doesn't go to court.

    While it is unusual for a first offender to be given jail time, it is possible.

    If she doesn't go to court? She will turn a misdemeanor theft charge into a failure to appear bench warrant that will complicate her life to a degree that is truly spectacular.

    Tell her to pay the civil demand she is about to receive. It will be for several hundred dollars.

    Tell her to go to court and pay the fine, do the community service and keep her nose clean during her probation... and for her to get an attorney to help keep it off her record.

    Have you ever herad of someone doing jail time for their fist offence?

    Do you think it the officer was using that as a scare tatic? (believe me it is working)

    Yes, but there was usually a higher dollar amount or another charge to take into account.

    For instance, if the person tried to fight their way out of the store or something.

    Having said that, there is nothing stopping the judge from giving your friend jail time instead of a fine, community service and probation. It just almost never happens.

    Have your friend get an attorney.

    When The Target Security came to get her she didn't try to fight but went with them quitly. she answered all their questions and corporated with them.
