    Default Kmart Got My License Plate - Now What?

    My question involves criminal law for the state of: North Carolina. I recently went into a local Kmart store and was very tempted to shoplift an item from the electronics department (value around $ 50.00). I went so far as to conceal the item in my jacket; however, I did have second thoughts and could tell that I was being watched, so I hid the item in another section of the store and left without it. I'm pretty sure that Kmart thinks I went out the door with the item, because a guy came out not too far behind me and I saw him writing down my license plate number.

    NOW WHAT??? Will it just be their word against mine since I don't have the item, or will the law be on their side if I happen to be on tape concealing the item and later walking out empty handed (even though I didn't take it, I wonder if there would be any circumstantial evidence if I'm NOT on tape putting the item back)? If you're not caught in the act and busted on the spot, how likely is it that they will follow through with any type of prosecution?

    Not leaving with items means little. Here is a portion of North Carolina law

    § 14-72.1. Concealment of merchandise in mercantile
    establishments.


    (a)Whoever, without authority, willfully conceals the goods or merchandise of any store, not theretofore purchased by such person, while still upon the premises of such store, shall be guilty of a misdemeanor and, upon conviction, shall be punished as provided in subsection (e). Such goods or merchandise found concealed upon or about the person and which have not theretofore been purchased by such person shall be prima facie evidence of a willful concealment.
    Notice that in your state "concealment" is a crime. If they got your plates and pursue prosecution expect a call, letter or visit from Police at some point
