My question involves criminal law for the state of: North Dakota
I was arrested with the misdemeanor charge of possession of Marijuana and paraphernalia in July of 2004. I received a deferred sentence and paid my fines. I was informed by different people of two different results. 1. The deferred sentence and arrest are dropped off my record after 1 year probationary period or 2. It will still be on my record as an arrest but not a criminal charge. I am wondering which one is accurate, or are neither accurate?
I am currently applying for an internship to work at a Department of Defense school and have to fill out the Questionnaire for Public Trust Position. The questionnaire has the question "Have you ever been arrested for, charged with, or convicted any offenses?"
I am just wondering how I should answer this question. Yes, I have been arrested, but was not charged with anything and was also informed that it would be removed from my record. What should my response to this question be? Do I have anything on my record anymore for them to discover, or has my deferred sentence and arrest been taken off my record?
