    Question Vindictive Ex Won't Allow Daughter to Get a Passport

    My question involves a child custody case from the State of: Oklahoma

    I've been divorced 2 years. Both of us have moved on. He lives with his girlfriend.

    The divorce decree says joint custody, I am the costodial parent with full decision making ability. He has minimum visitation rights.

    I am marrying a man from the Bahamas. We are planning the wedding on the island where he lives. My ex is refusing to let our two daughters have passports just because he said so.

    He was abusive and controlling when we were married and is basking in the ability to control me with this passport law.

    Is there any court I can appeal to? Can my lawyer do anything about it?

    My lawyer had said I had full custody, but that they'd changed the wording, but I'm afraid the word "joint" still counts.

    Please is there anything I can do? The girls would be so upset if they couldn't go. (They love their new step dad very much)

    I'm not a lawyer but what you have is physical custody; you and your ex share a joint legal custody agreement. In a joint legal custody agreement, he does have a say.

    You can speak with your attorney and explore the option of requesting a mediation hearing regarding this matter and let the mediator decide. Also, the mediators decision, if not in your favor, can be appealed if you decide to pursue the matter beyond that.

    I always thought joint custody was equal say in the kids lives but this is what the decree says.

    "The parties are awarded joint custody of the children with the Respondent (me) to be the primary custodian and decision maker."

    Read this. Scroll down to "One Parent (with sole legal custody)". You can see if they will accept your court order as establishing you as having sole legal custody, on the basis of your designation of sole decision maker. If not, you will have to go back to the court and ask to be specifically designated the sole legal custodian.
