    Default 10 Year Ban

    OK so heres the situation.

    Im married to a US citizen and I have an approved I-130 I have every that the paperwork require except the G-325A, Ive no friends or relatives here that qualify. So Im looking into returning to the UK just after Christmas. BUT I dont want to encurre the 10yr ban. Ive been here in the US for 22 mths where Ive not worked and simply survived on my savings which now are almost exhausted. The paperwork is going to cost too much and Id really like to just go back to the UK, earn some money to send my wife and daughter but also have the ability to return to the US.

    Ive read somewhere about a voluntery deportation scheme that allows immigrants to deport themselves in order to return home and not encurre the same bans and such as someone who is deported by the US.

    Can anyone help?

    I don't understand, if you are married to a US citizen, why don't you apply for an adjustment of status. Your spouse is considered an immediate family member. Is there an issue with your entry? Did you over-stay your visa or enter without permission?

    That aside, what is the real issue? Are you in removal process, that being the case a voluntary departure ("VD") may be applicable. A VD will help you avoid a 10 year ban that comes along with a final order of deportation.

    Nonetheless, I don't understand why you haven't applied for I-485 along with your I-130?

    Basically it came down to money and some bad advice, I had saved enough for the I-130 so I send that off. Next I had to save for the I-145 but then found out that its not just one form but a package. Everything has been filled out BUT I dont have a sponsor.

    My wife looks after her Dad and two daughters, she lives of his pension and government benefits so she dosnt qualify to be a sponsor.

    Basically, what Im wanting to do is travel back to the UK either Jan or Feb next year but have the ability to return to the US and spend time with my family over here until such time as my wife is in the position to come to the UK, which wont be until her father passes on.

    No Im not in removal process, Ive not got any legal issues right now just monetary I guess. I just want to avoid the ten yr ban and have the ability to visit and spend the holidays with my wife and daughter.

    Ive been looking around and Im still kinda unsure about the position of avoiding the 10yr ban by Voluntary Deportation...
