    Default Price Tag Switching

    My question involves criminal law for the state of: Texas

    First Time offense. I don't even have a speeding ticket on my record.My record is spotless.

    I switched a price tag on an item that was at regular price with one that was on sale. The difference was $136. I was released with a warrant to appear for magistrate. The actual charge has yet to be stated nor have i seen any paper work. From what i gathered from the officer and the Security "gossip" it is going to be Class A Misdemeanor Fraud.

    Can they charge me with fraud? And if so how much trouble could i be looking at. Once again, i have never been arrested. This is a first time, and for sure the last time.

    First, your record WAS spotless.

    Second... you will receive a civil demand letter in the mail. It will be for several hundred dollars. Pay it.

    Third... you will get an attorney. You will ask the attorney to help you get the judge to give you diversion which will keep this off your record.

    Fourth, you will do your probation by the letter or else this will stay on your record forever.

    Fifth, whether or not the theft is removed from your record, your name will be entered into the National Theft Database and, odds are, you will never work in retail again.

    Thanks for the reply cyjeff. Been doing alot of research, and from what i have found, it looks like (if my attorney is half decent) that i should get deferred since i have no priors. Knowing this i will def sleep better.

    Only thing that bothers me is that all laws i have read under the penal code shows this to fall under Class B Misdemeanor Shoplifting. Can they charge with Class A Misdemeanor Fraud? and if so on what grounds, because i cannot find anything on this.

    I wouldn't take hearsay too seriously. I think it will end up a simple class B misdemeanor. Which is bad enough.

    Agreed.

    You didn't rob a bank.

    However, your attempt to save $150 is going to cost you around two to five grand to make sure it doesn't muddy up your life.

    Which is proof that we live in the greatest country on earth. You are allowed small mistakes, you pay for them, but you can still go on with your life.

    Thanks everyone for your posts, you have set my mind at ease. We'll get this worked out. My lesson is learned, i will pay my fines and restitution and continue on with my life.
