    Default 17 and with Child

    My question involves marriage law for the State of: texas

    im 18, and my girlfriend is 17. we have a son that is almost 1 year old.
    my question is even though she is 17 can she move in with me and get married?
    she does not want to be with her parents anymore. the mentally and verbally abuse her.

    well i was told by officers that as long as she is in school, not married or emancipated she cant but the officer said that he thinks she maybe able to since im the father of the baby. but hes not 100% sure..

    Ask the officer where he went to law school.

    Until she is 18, she lives where her parents say she lives.

    even with a kid? and movin in with the father for safety reasons? also she turns 18 in February so even close to her 18th b-day she still cant?

    How many people have to tell you the exact same answer before you believe it.

    Even if...

    Getting pregnant does not emancipate your girlfriend to come live with you.

    Yes. Even with a kid*. Even for safety reasons. Even if her 18th birthday is so close.

    She is considered a legally emancipated adult on her 18th birthday and not one day earlier.

    *In fact, having a child makes it LESS likely, not more likely, that she will be legally emancipated by a court early. Pregnancy/Maternity grants her medical emancipation ONLY - it makes legal emancipation tougher since it's harder for her to fulfill the requirements.
