    does the LL have your forwarding address?

    has the LL sent you anything regarding the deposit?

    Yes, I sent it via certified mail along with the rent last payment (it was delivered to her on 9/18), but she also replied to an email that I sent to her with the certified tracking number, saying that she had received the forwarding address, and would be in touch via mail.

    That was the last I heard from her until the day that I filed (which was about 60 days after lease termination). The same day that I filed (which I think was coincidence), she emailed me saying that she apologizes for not contacting me, and that she thought that she had my forwarding address, but doesn't, and asked that I provide it.

    When I told her that I had filed a small claim, and would drop it if she gave the deposit back, she said that she had filed a large civil suit, and that I gave up my rights to acknowledging any previous damage to the home (from before I moved in) by not getting her a list of damages to begin with. (ps. Wouldn't he need my mailing address to file a civil suit anyway?)

    The tenants previous to me had the same problems, and told me that she was trying to sue them for damage that was already done also. But they took him to court and won (last year).

    Anyway, thanks for the advice. I went to the post office today and received the signature that showed that he had indeed signed for the letter...

    Last question- do you know when I should receive the court date in the mail, or when he will receive the summons?

    fair enough. students do post here all the time. the two threads were to identical to be anything other than what you have explained or a couple students in the same class.
