    Default NICS Delay - Unresolved Answer

    My question involves criminal law for the state of: Nevada.


    I was arrested for DUI metabolite (marajuana) earlier this year in Utah. I live in Nevada. I have made a plea bargain to have it reduced to a drug related wreckless driving with 18 month probation and an evaulation. I am not an addict. Just too much fun that week in Utah. I am now trying to purchase a handgun. The NICS came back with a "delay". I waited the three days. The third day it came back as "unresolved" which is a "default proceed". I have heard in cases like mine the FBI and ATF review these cases and if decided come and re possess the firearm. What can I do to not allow this to happen? Or am I worring about something that is not going to have any relevance.

    What can you do to keep a firearm if you're legally prohibited from possessing firearms? You can explore whatever restoration of rights provisions are available in your state and pursue them. Failing that, or if they're not adequate to overcome the federal prohibition on your ownership as a convicted felon (although what you describe sounds like a misdemeanor), you can surrender your firearm.
