Hi, I have an issue with the legality of my lease agreement. I signed a lease agreement in 2006 for a period of 1 year, thereafter we just continued to pay on a month-to-month basis.
In the meantime, the original landlord has sold the business, and the new landlord sent us a letter stating new bank details. I asked the new landlord for a new lease agreement, to which the response is that in the LA there is a cession clause, which gives them the right to take over the existing lease agreements without issuing new LA's.
I have subsequently moved out, and now the landlord is giving me uphill over non-payment of penalties and other issues, and wont refund the deposit.
My question is, how valid is their claim according to our original lease agreement if it expired over a year ago, and the new landlord did not give us any legal paperwork in terms of the new ownership? I asked for a copy of the Cession Agreement, and was told that I don't need to see it.
