    Default Changing My Surname

    My question involves divorce in the State of: North Carolina

    I got married in North Carolina. My husband filed for divorce in North Carolina as I was in New York and it would have taken longer for me to file it. During my research, I know that if I were to file for divorce in North Carolina I can request the judge to give me permission to change back to my maiden name. However, as it was my ex-husband who filed it, I did not see this option in any of the paperwork. Now I'm told that I need a legal document from the judge to be able to change my name. What is the process to do that? Would it cost me anything? I noticed that name changing fee are about $200. Can I get it done in New York?

    If you wish, file a counter-complaint. But generally speaking, all you need to do is include a name change provision in the ultimate judgment of divorce.

    Well, the divorce has already went through, can I get them to show that a name change is allowed?

    If you chose not to change your name as part of your divorce, it's probably going to be at least as much cost and hassle to try to reopen your divorce, plus the judge may say "no".
