My question involves a speeding ticket from the State of: California
I got a 22349 ticket on Sunday morning for going 81 in a 65 zone. I haven't been pulled over for speeding before so I probably didn't handle the situation perfectly, but I was courteous to the cop, didn't whine, didn't beg, but I also didn't ask much in terms of questions.
First off I was driving pretty normally and at the time I was pulled over I was actually going with the flow of traffic (I know this is not a defense) between a couple of cars. The cop when he pulled me over asked if I knew how fast I was going I knew not to incriminate myself and said I wasn't sure of the exact speed, but neither did I throw out any numbers. He proceeded to write me the ticket. I knew I wasn't going 81, and in fact I know I was below 80 the whole time.
On the Ticket the officer did not write down a radar number, nor did I ask how he obtained my speed. Is it possible that he used a radar and didn't write down the number or does this most likely mean he paced me to get my speed which makes no sense since I only saw him behind me a few seconds before he flashed his lights?
My real question here is this. I know this is a $266 fine because of it being 81 instead of 80, and from what I'm seeing my only real way to win this case is on the technicality of filing for discovery with the DA and not getting any evidence back from them, the officer not responding to the written declaration, and/or not showing up to court. Should I just suck it up pay the fine take traffic school to avoid the point, or are my chances at winning by these technicalities good enough to try them?
