    Default Marijuana and Alcohol Arrest at High School

    My question involves criminal law for the state of: PA

    Hello, i was arrested this past weekend. I was at my high school (I am 18 though) football game. After i pulled up, my friends put 2 marijuana bowls and a handle of alcohol underneath a sweatshirt in the passanger seat. The officers noticed this activity and said we were acting "suspicious". As a result they ran my plates and my registration was still under an old car we had owend. A mistake at the Volkswagen Dealer led to this mishap, where they had used a wrong letter in the identification of the license plate. My first question is if i can sue VW for this? Once i had gotten in my car, i was immediatly pulled over, literally 15 feet later by cops banging on my windows. I stepped out and they asked how much i had to drink, i blew a .07%. The officers said besides the fact my registration was wrong, they said they could see the alcohol in the car. I knew this was a lie because we intentionally covered the items up with a sweatshirt. My second question is, if the officers said the could see the alcohol, is it negligence on their part to let me into my car, endangering myself and everyone around me? Is this something i can sue for, or just push to get the dui off? My third question involves when the officer was reading me my miranda rights. He said "If you cannot afford a lawyer one will be appointed for you, not that we don't think you can afford a lawyer, look at the house you live in, the money in your wallet"...i believe he also made a reference to my last name but i do not remember. I am bringing this up because I am of Jewish heritage, and would this be right to sue for Defamation of Character?

    Get a criminal defense lawyer and have him sort all of this out. Bottom line is you are 18 and drinking alcohol which is against the law and you know it. You were in possession of pot which you know is against the law. Then you made the decision to drive a car placing all around you in harms way (who get no say so in it). If your not smart enough to not get caught, be man enough to own up to it. Then you come here asking how you can sue everyone involved? This is 100% your fault and you are 100% in the wrong. Had my kid been in the car with you when you were caught, I'd make sure you got everything coming to you and then some.

    Hey Genius- Of course you will get the charges reduced, and of course you will get into college. Daddy's money does wonders. What you also will get is caught again, because the cops now know you and will be looking for you. Why don't you sue your parents for having sex, and giving birth to you! Eventually all of Daddy's money and favors won't work, remember don't drop the soap!

    Anyone can sue anyone else for anything. You can sue them, but chances are you are not going to win ... suing the dealership for a clerical error that resulted in the discovery of criminal activity is not likely to set well with a jury. But, if you can convince daddy to spend thousands of dollars for a case with little chance of winning, go ahead.

    Seeing alcohol is not the same as allowing an obviously intoxicated individual to drive away.

    No, they committed no act of negligence.

    Is this something i can sue for, or just push to get the dui off?
    Neither.

    I doubt it, but if your dad wants to spend thousands more dollars on a questionable lawsuit on an allegation with no damages, that's up to him.

    Perhaps you didn't cover the alcohol good enough? Or perhaps they saw you hiding it? Anything is possible.

    You want to sue Volkswagen because their mistake led to you getting arrested for possession and DUI? By all means, knock yourself out!

    You're the one who messed up by consenting to a breathalyzer! What kind of idiot does this? That just strengthens their case MORE! I don't think you'll be getting out of this one!!!

    You seriously need to get a life! Your attack on Gigirle was childish and unjustifiable! Grow the hell up!! Come back when you're able to hold an intelligent conversation without berating people who out rank you in age, class, sophistication, and IQ points!

    I don't want to sue VW, i just want to know if i can because they screwed my registration up, which yes did lead to me getting pulled over. I was trying to cooperate as much as possible, and if i refuse a breathalizer i would be taken to the hospital where they would have a more accurate reading, leading to a higher BAC. So what kind of idiot refuses one? I have a life trust me. I was attacked first, childishly by an ADULT, parent at that. Oo, and trust me, I can hold my own in an intelligent conversation without berating people. I highly and i mean HIGHLY doubt you have a higher IQ or class than me. In fact, ill just share with you that my IQ is above 140, not going to say the number, but yes, ABOVE genius. In terms of class, I am in the upper class, so tell me, what are you????

    Stop attacking me because I am an 18 year old High School Student. I just as easily could have said I was a 35 year old man who works in a power plant...than what would you have to say. The fact of the matter is, adults continue to look down upon children and teenagers without looking at the facts or figures. You are speculating that your iq, class, sophistication, etc. is higher and of more value than mine. Obviously you have an inferiority complex, which is not something to be proud of. You think you are better than me which is also not something to be proud of. We are all equal and until you can see that, I have nothing left to say for the reason that YOU cannot hold yourself in an intelligent conversation

Genrally, when someone does something stupid, it dosen't make much sence to ask for help, then whip it out and have a measuring contest with the pople who reply to YOUR problem. You may be "book smart", but is seems you are far from "street smart". Go get a yellow paged book and look up "Lawyer's". If that is too much for you to handle, Barns and Noble sells "I'm about to screw my life up if I keep going down this road for Dummies".

    I tell you what.

    Anyone that is stupid enough to bring grass and alcohol onto a school campus deserves what they get. You just changed misdemeanors into felonies.

    You need an attorney. Now.

    When you get to court, don't talk. Let the lawyer do that. You obviously have verbal control problems.

    If you are lucky, you may be able to get the charges reduced. I wouldn't count on it, though.

    As for the last piece, however, you could always file with the officer's superior. It won't change your case any.

    On an aside, when was pot declared kosher?

    O and I do realize the significance to my background check and record. Trust me I was the one devostated by this from the beginning. I knew this as soon as I got pulled over. Like I said, I'm not dumb or a wash out like you may think I am. I wanted to be in the Biological Research field, however I know this may be harder now. My father is a doctor, and that was one of my back-up plans. According to him, I can still easily become one. Can't wait to see you in my office!

    EDIT: HAHA, i love the kosher part. I am atheist myself, but raised Jewish and belong to a Jewish family. Also I'd like to share a story about how a 18 year old last year was caught with perkoset, oxycotin, and marijuana on SCHOOL CAMPUS. All of his charges were dropped to misdemeanors, and he didn't go to jail AT ALL. He currently attends the University of Sciences of Philadelphia, ironically for pharmacuedicals.

    But you are right... you don't have anything to worry about... and neither does your drug dealing friend.
