My question involves criminal law for the state of: New Jersey
I received a noise violation for being on the street at 3AM, making no noise. Earlier in the evening, I called 911 to remove persons who were yelling outside my home. When 911 arrived, the officers found no one (they had left) and instead warned me about having noisy guests.
The officer issued me a noise violation because he said he had reports that a green car was making noise, and I was near a green car. He questioned the green car driver, found no problems, and let him off, but not before issuing me a violation because, quote, "it was the second time [he] had to deal with [me]".
Nevermind that I am completely innocent as I was not making noise (that doesn't matter much, it seems), I am looking for ways to figure out how to beat this, since it will be officer word versus mine. The complaining witness to the noise violation is the officer, which I didn't think was allowed in NJ? How do I fight this? Any help at all? Can I read South Orange or New Jersey law online somewhere, to pick this apart?
