    Default Any Possible Waiver for Deported Person

    Hi my case is, I was a legal resident in EE.UU. for 13 years (1994/2007) two kids (9-11) they borned and living in new jersey and I married to my girlfriend nine months ago she is an USA citizen, in 2001 I've been charged of ENDANGERING WELFARE OF A CHILD i was given 3 years probation, and parole for least 15 years (no jail time), it was not aggravated felony, my lawyer pleaded me guilty to avoid trial ($)...when I finish my 3 years probation with non problem I started serving parole and after a year, I was taken by "ICE" and put on removal procedure in 2006, my immigration lawyer just waited for me to be deported (2007) when I already was 7 month detained by ICE.
    the charge is related to sex abuse even though there were not any kind of sex contact, but, they say I had the intention and put her in danger....now i am back to the dominican republic after i had 13 years living in USA...

    MY QUESTION IS: there is any chance or way to get a waiver at least to go visit my kids or go back to live in new york?

    any information will be very helpful, thank you very much.

    But has anyone heard of any case similar to mine in which it was possible to obtain a waiver?

    your lawyer waited till you get deported? wow that was not a smart move at all.. he should have taken u to an immigration court and didnt wait for you to get deported.
    now that u got deported, u cant do anything right now.. really cant. no matter what, u cant file a waiver, coz u are already been deported, and with ur case no matter u were an lpr, all u can do is to wait.
    i wil confirm to my lawyer,

    WELL, my lawyer when a couple of time to imigration court, but only to recuest 2 and 3 month more until the judge told him no more time and signed my deportation, since he never show any docs asked by the judge, and he even didn't give me no copy of anything document and every time i ask him about it he just told me he was busy....

    people with deportation orders are clearly the most vulnerable to immediate detention and removal from the U.S. It is important to note that immigration law allows some individuals with deportation orders to reopen their immigration case and pursue some form of relief that can lead to legal permanent residency and citizenship. It is imperative that individuals with deportation or removal orders seek the immediate assistance of a reputable and experienced immigration lawyer to evaluate if a case can be reopened.

    Deportation may be reopened by the filing of a motion to reopen. Generally, a motion to reopen must be filed within 90 days from the date the removal order was issued. A motion to reopen must also state new facts that were not previously available. There are exceptions to the 90 day filing rule. The following are some examples. First, if a person was ordered removed for failure to appear and did not timely receive notice of the time and place of the hearing. Second, if there is a change in country conditions in the person’s home country and the person fears returning. Third, where an alien falls victim to ineffective assistance of counsel or fraud by a non-lawyer such as a notary, paralegal, or immigration consultant. A benefit of filing a motion to reopen is that an immigration judge can issue a stay of removal which means that ICE cannot deport that person while the motion is being reviewed. In some cases a stay of removal is automatically set in place when the motion to reopen is properly filed.

    thaks for all that information, but im already out and i am trying to find any legal way to go back and visit my kids or live in USA land, so i just would like to to know if there is any chance,( I also believe i had been lifetime deported) JUST WANT TO KNOW IF EXIST ANY OPPORTUNITY for me or i can start thinking that i won't ever going to see my kids again, i understand they can flight to my contry to come see me, but it's mean 3 tickest that mother can not pay and neither me in my country (D.R)..... it is a sad situation where some people seen to have not a second chance........but thank you all for your help...
