My question involves collection proceedings in the State of: Kentucky
Recieved notice today that I am being sued for a bill my deceased wife had. The company suing is from Canda but has a lawyer/debt collector in my home state.
My wife used to own an online store-the company suing me is her web hosting company that she had the online store through. She has been gone 5 years this past October. The store was not in my name, nor was the hosting service in my name. The bill is from them hosting the website-she got terminally ill and was not able to keep up with it and well it was the farthest thing from our minds. Can they legally hold me responsible for this debt? If not what should I do?
Two months ago I received a letter trying to collect the amount which was around $3000 at that time. I contacted the debt collector and told them she had been deceased since 2003 and was told they would take care of it. Now I am getting a letter in my name from the County Court Clerk showing where they are suing me for $5000.
Do I have any rights to dispute this? My wife did not have an estate to probate and any insurance money received was used for funeral expenses and I paid off a few credit card debts she had with the business. We did file something with our lawyer a few months after she had passed but that was years ago. Looking for some advice. Thanks.
