Question Changing Son's Last Name to My New Married Name

My question involves name change laws in the State of: New Jersey

When I was pregnant with my 7 y/o son there was three possible men that could be his father. Two were tested and proved not to be the father. There is no father listed on his B/C. One of the men tested and I ended up raising my son together. We are now married and trying to have a baby. My son has my maiden name. I would like to change it to my married now. My son would like this also. He only knows my husband as his Daddy. Do I need to contact this man who has NO idea about my son (we only met once that one night) and is sitting in prison?

More than likely you will need to seek out and prove who Bio Dad is and then ask for TPR which he can refuse. However being in prison makes it somewhat easier. This not a do it yourself program so consult an Attorney
