My question involves a roommate in the State of: California
I have a 1 year lease and I am listed as the tenant. Although under the section "The premises are the sole use as a personal residence by the following" I have my roommates names but they did not sign the lease. All the utilities are in my name and the roommates pay me their share of the rent which I then pay the landlord.
From what I understand they are legal occupants. One roommate is late on paying his share of the rent (verbally agreed to splitting the rent equally, no documentation other than the lease).The roommate seems to want to pay less than what was agreed upon and is an overall nightmare of a roommate.I told him that wasn't going to happen and he needed to pay in full his share of the rent/utilities.
What would I have to do to legally remove this person if the rent is not paid in full? 3 day notice to pay or 30 day? I know he will stay until the very last day possible. If say I am able to evict him but he stays would I be able to sue for back rent or is not even worth trying? Thank you for your advice.
