    Default Indiana Accident with No Insurance

    My question involves an injury that occurred in the state of: Indiana

    My husband traded his motorcycle for a Dodge truck, the kid said I'm going to take the bike for a test drive and bring back the title and truck. The kid had an accident and the bike was impounded, he then told us that he would bring us the truck. His dad hid the truck because he didn't want us to get it. The kid brought the title to us, we waited 2 weeks, contacted the police, they talked to him and he said I'll have it to him by Monday. On Tuesday he told us where the truck was, we contacted the police told them we were going to go get it, but we'd probably have problems. I took my husband to where the truck was, he had a set of keys, he got in the truck and left. I was just a minute in front of him, I pulled over at a gas station to make sure he was coming, 2 vehicles were chasing him. I called 911 and told them what was going on. My husband came to a stoplight and the last vehicle came around on a 2 lane highway into oncoming traffic and slammed into the driver side of the truck. My husband went into the ditch and drove directly to the police station. Their truck was seriously damaged and they headed home where the police found them. The whole left side and back of my husband was hurt but we didn't have health insurance so he didn't go to hospital, his leg and hip are ok, but he still has problems with his back. He has been to hospital since then but they didn't find anything. Anyway, we didn't have insurance on the truck, what can we do? Will an attorney help us on contingency since it wasn't a serious accident and we didn't have insurance? Thanks!!

    Did the person who hit the truck have insurance? Otherwise, you may have to sue the driver who hit the truck for damages to the truck & medical bills for your husband's injuries.

    Yes, his insurance company sent us a letter stating he said it was our fault, I have called the insurance company but they won't call back.

    You might have to sue. You might want to get an attorney's asistance since the other party's ins. co. seems not to want to pay or return your calls. Maybe he will be able to get in touch with the other person's ins. co. If they won't offer a settlement, the only option would be to sue the other party since it seems they were at fault.

    You can probably get a referral to an attorney from your local bar assoc. or if money is a problem, from your local legal aid society.

    First, did you call your carrier and inform them of the accident? You need to do this as some policies provide certain coverage on a newly acquired vehicle. I've not looked up state laws for Indiana but the coverage you have on your other vehicles _may_ apply to you and not a vehicle your driving.

    I re-read your post. Are you saying you did not have insurance on the truck being driven or did not have insurance at all? If you did not have insurance at all... I think you made _serious_ error after error.

    Did the other carrier deny your claim in writing? It's not a denial until it's in writing. If no written denial has been sent, you need to file a complaint with your states Dept of Ins. You can also call the carrier and ask for that person's supervisor. No response from the supervisor... call the supervisors supervisor. Allow them a day to call back and then keep going up the chain of command.

    If the other carrier is denying the claim stating it's your husbands fault then I think you are probably leaving out part of the story. Also, there is a possibility that the other carrier would deny their insured coverage for an intentional act.

    You can always file suit against the other party as mentioned.

    This deal went south when the person showed up without the title to the truck. The deal should have ended there. Everything done after that just made this matter worse and worse. There were many times when you should have bailed out of this "deal".
