My question involves collection proceedings in the State of: Oregon.
I had a son two years ago prior to marrying his father. Now I am a married stay at home mom and we have been served a writ of garnishment naming my husband as the resposible party. Is he liable for debt in my name prior to our marriage? I had my own insurance, which my newborn son was placed on at birth. The father is not even on the birth certificate (hospital error) but I believe he signed paperwork at the hospital. The bills are all in my name. We are in touch with a lawyer in attempts to dispute the claim that my husband is resposible. Do we even have a case?
