Getting Sole Legal Custody, Child's Dad Won't Acknowledge Disability

My question involves a child custody case from the State of: Massachusetts....I apologize for the lenght of this post, but there's so much going on!! My ex dismissed the thought for 8 years that there was anything wrong with one our children, and recently one child was diagnosed with Asperger's. I tried to keep him informed of everything: testing appointments, meetings with the shcool - everything, and he only ever said 'just let me know what's going on,' never wanted to attend or called to ask what happened. He used to see the children (twins) every other weekend, but has gotten "too busy" and decided he would let me know on a week by week basis when he could see them - which is now about one day every/ every other weekend. He never calls them, he's said "they have my number, they can always call me." When I told him of the recent Asperger's diagnosis of one of the children, he's now decided there's nothing wrong with her, "doesn't see any of the symptons" everyone else (including 3 specialists) sees, won't agree to have her go on medication to help her diagnosed depression, and has contacted all of the doctor's for 2nd opinions without letting me know first. He tells her, on the one day every week/every other week, that "she's fine" "it's o.k. to be depressed" "she should 'snap out of it'" which is causing her to be upset after seeing him.
We now have a wonderful family, I'm recently remarried, and my girls love their new stepdad, and he adores them.
I want to get sole legal custody so I can get my child the help she desperately needs. I do have some email corespondance with him documented, but some was done by phone, I'm not what my chances will be be? Thanks All!
