My question involves divorce in the State of: NC
My ex and I are on a home loan together. We started renting that home out through a rental agency approximately 3 years ago. The incoming rent is more than enough to pay the agency fee, taxes/insurance and the mortgage payment, with money left over.
The ex went to the rental agency when we separated last year and had themself listed as the only one on the rental agreement. Ex has been receiving the rental payments for the property, yet hasn't made a house payment to the mortgage company since May. I just found out it is going into foreclosure.
My question is this... could the ex be in any type of trouble for this? Can I be held liable for anything with regards to the renters and rental agency suing due to non payment of the mortgage when they paid the rent in good faith. My attorney was notified, but didn't seem too interested in this information, even though I had pushed to have the home included in our ED.
