I have a situation that is in this line, however I am already divorced.
Approx 1 month ago my ex filed charges against me alleging that I came into her home at approx 3:30am and beat her up.
She was actually drunk, and fell in the bathroom and hit her face on the vanity, toilet, floor, or something...
She went to local Sheriff's department and had a arrest warrant signed out against me.
Here are the facts:
I live approx 200 miles away from her
When this happened I was actually 329 miles away.
I have fuel receipts showing I was in this location.
I have my cell phone records showing I was receiving and placing calls from this location.
My son who lives with her picked her up off the bathroom floor at approx 4:00am, and will testify that I was not there.
My son is how I found out about the warrant, and I called the sheriff's department and verified.
Sheriff's department advised me to call the DA.
I have called the DA they will not return my phone calls.
What can I do. I live here in a state of fear now. I'm always afraid that if in fact I do get pulled over for a traffic violation, I will get arrested, or I may receive a knock on the door from the local police and be arrested.
I'm not concerned about proving my that I am not guilty, I'm concerned how someone can do this and what can I do about it. I feel so helpless.... Am I to drive across the state and turn myself in? What about my children... I assume that I can sue her in court, but I don't want the expense, and she doesn't have anything to go after anyway....
This is so wrong... Perhaps I should file false charges against her here? (I would never do that, I'm just venting)
Any advice on this would be appreciated... I live in the state of Tennessee if that makes any difference..
