My question involves expungements or pardons for the state of: NEW YORK
I am so lost its not even funny. In 2004 I had a dispute in a relationship where I was accused of threats, where this person accused me of threatening them and then called me two weeks later, and I was accussed of some other garbage that never even happened. I don't feel like getting into the person threatening me etc... I was taken down to the precint then, I got fingerprinted blah, blah, blah and then I was set a date I guess for a hearing or something like that ( I cannot even remember what the appointment was for). I wrote my statement. When I went there I never even seen a judge or anything. After waiting forever and a day we decided to ask them about it. They could not even find anything there about me. I was not fined or nothing. No bond, no bail. No community Service. The stupid cop did tell me I was going to get 6 months probation, I did not even get a notice about that...No Probation Officer. It was like they threw the entire thing out of the window. They told me they dropped the case. But here is the problem. I do have an arrest number etc... I also have a letter of disposition, and a decline to prosecute form. When I inquired about it I forgot how long it has been, they told me the record was sealed. This is the problem: When I applied for jobs that require me to be fingerprinted my fingerprints still comes up (I have not been denied these jobs however which is a blessing).I found out that my prints came up when I applied for a hospital job, and got hired. I was lucky that I was still able to work. I even managed to get a job in a bank.
I am lost. I do not even know if it was convicted, or a non-convicted arrest.
I have been doing research but the more research I do the more confused I honestly get. I know that once a record is there even if falsley accused(which does happen) it is there but how do I get it so that it won't come up on a background check, and even if its sealed does it mean that my fingerprints will still come up in the system? Something just does not seem to make sense to add up.
If it was sealed what is the point in it being sealed if your fingerprints will come up in the system if fingerprinted for a job?
What is the difference between sealed and expunged records? They say juveniles records are usually sealed so does that mean if they are fingerprinted for a job does that mean their fingerprints for a juvenile record will show up? I know NYS does not expunge records they only seal them. I called them and she told me.
Was this case even really sealed? I am starting to question that.
Can someone please help me?
I think I may need to request a copy of my record, then do what? This crap seems to keep following me all for a bunch of false garbage.
And whats the difference between a record and a rap sheet?
In terms of employment once I start to find another job I am planning on applying for a magazine company. Will my one time history come up? Will they fingerprint me for that kind of job? I plan to move up in this job so if I do get hired I do not plan on leaving unless its to start my own business.
