It's not right, but it is legal. I had to endure 2 years of delays for every idiotic reason my ex could come up with before my divorce was final.

Apparently what your ex did is very common with most people. I have been fighting to get child support out of my ex for a year now, and he has come up with some doozie of excuses. AND, the JUDGE lets him get away with every single one of them!!!.. The judge tells him.."Oh, you need to look for more "gainful employment"... When in fact, my ex has no desire to work AT ALL.. Just to get out of paying support. He has even told the people at Domestic Relations that he desn't even think our two kids BELONG to him(biologically)... They are 13 and 8.....I have to go back into court on the 17th of ths month because Domesctics has taken him back for CONTEMPT, because he refuses to pay.... If you ask me, I think you should get tochoose what happens to them... and I would choose they throw his BUTT IN JAIL!!! Even if it means no payments, I haev lived this long without them, Make them pay for not paying child support when it is COURT ORDERED or throw them in jail!!!!

Unfortunately the way alot of judges look at enforcing CS is that if the NCP is in jail they can't pay anything, so it's better to have them out where there's a chance they'll pay. I say throw them in jail. 9 out of 10 times they suddenly come up with the money!

I was told by a neighbor of mine that in some situations, when they put the people who owe back child support in jail, they give them a job while they are in there to pay for what they owe... it's kinda like "work release", but they don't go outside the jail to work in public places, they work right there inside the jail,( doing dishes, cleaning floors, and stuff like that) for the jail, and they make money doing it, BUT, ALL the money they make goes to the person they owe back child support. They don't get to keep any of the money. I personnaly am to the point right now, that I don't care if he makes money in jail topay off his back CS... I think he needs to sit in there awhile to realize what his OBLIGATIONS are... especially when he refusesto work to begin with so he can pay child support, and now, almost 13 years later, he is DENYING PATERNITY of our 2 kids, just to GET OUT OF PAYING!!!! He needs to ROT in that place!!!!!

Several states do this. Some will even try to arrange a job outside of the jail so that the money is not coming from the county or state. It's been done in Texas before and on top of the money going to CS they also had to pay for their room & board at the jail!
