    Default Getting Relief from Registration After Pleading Guilty to a Sex Misdemeanor

    live in california in 1976 i plead guilty to a sex misdemeanor
    can i be relieved of lifetime duty to register ?
    my probation ended in 1979
    in 1991 i got a pc 1203.4 / 1203.4a petition and relief order from
    a judge in the same city of my conviction { 6 28 91 }
    my old case was set aside back then and dismissed on that date
    but now after the 1996 california megans law was passed
    in 2003 i was required to register for life for a 1976 misdemaenor
    [ 288 P. C. ] or a [ 647 pc ] - from the year 1976 ( 6 .30 .76 )
    only one misdemeanor conviction
    my conviction was not even a felony and i did no time in any
    prison and or jail , just some probation @ 1976-78
    i am not on the state megans website or required to be so and ....
    i still have copies of all my legal paperwork from back then etc...
    can anyone help me with the following
    Can i be relieved of my duty to register as a sex offender for life
    here in california -
    can i finally get removed from having to register as a sex offender now
    ??

    The governing statutes are here, California Penal Code Sec. 290-294. Sec. 290.5 suggests that your first step is to seek a certificate of rehabilitation relating to your conviction.

    A conviction of PC 288 is not subject to expungement per PC 1203.4 ... at least ... how you got it expunged in 1991 is a mystery to me. Plus, an expungement also does not relieve you of your registration requirement.

    As Aaron pointed out, you will need a different document by the court in order to relieve yourself of the registration requirement.

    my conviction was a 647a in 1976
    the 288 was pending and was never filed
    back then

    lincolnmontana, Did you ever find out what form you needed to file and how the process works to get a certificate of rehabilitation relating to your conviction?
