So if I have 3 appraisals all from certified appraisers who routinely testify in court actions such as this and all from within the past month that show the house is worth $450K and my wife has an appraisal that says it's worth $350K you think I should acceot the $365K and walk away happy??? I'm not sure of this logic.
In fact, the appraisal she got for $365K is just one month after SHE got one that indicates $475K. She says the market is why it dropped $110K in one month. Even the judge said that was highly unlikely and that's when teh judge told her that if both parties could not agree (she was visibaly angry with the wife because of teh loball appraisal) on the true value of teh property that the judge would order it sold.
You never mentioned that you had 3 appraisals, and you also never mentioned that your wife had one as well equal to yours. BIG difference.
Can't the court order that BOTH husband and wife must agree on the actual selling price since both names appear on the deed?
Another big item you left out. If your on the deed, you should have equal rights to the agreed upon selling price. This isn't asking much.
I fired my lawyer on Friday
Good, sounds like it's the right move. Based on what you've written.
Now I need to have my ducks lined up in 3 days to appear back in court to discuss the home appraisal which I plan to contest the $365K value - had another apppraisal done in the past 2 days - and plan to also seek the pension information. I agreed to give her half my pension - but I get none of hers?? Everything else we have agreed on now that the lawyer was fired - I've gotten them to agree to considerable changes to make the resolution more equitable
IMHO, you need to inform the judge that you have fired your lawyer and ask for time to get a new one. IMHO, your not asking for too much.
Can a judeg rule that both parties have to agree on the selling price and perhaps set a time frame to do so (1 year?).
Yes.
