    Default HSBC Won't Send Lien Release, Bike Paid Off

    My question involves vehicle registration or title in the state of: Kentucky

    I bought a motorcycle about a month ago and the owner said that the motorcycle had been paid off and the request for the lien release had been sent to HSBC. I found out the next day that the lien release has never been sent and that I can not transfer the motorcycle. I have talked to HSBC and the motorcycle was paid off in 2005 and that the account has been closed due to inactivity. Can I hold the seller of the motorcycle accountable and get my money back or is there any way to get HSBC's attention and get them to send a lien release. I have been trying for a month and keep getting nowhere. I hear nightmares about this company and am looking for some way to get their attention so that I am not out $4,500 for a motorcycle I can't do anything with.

    Didn't the seller give you his title when you purchased the bike? If so, HSBC would have had to sign off on the front of the title where their lien is listed. If you have no title....you have no proof that this person actually owned the bike in the first place and had any right to sell it. Occasionally a lienholder will forget to sign off on the front of th title and will then send a letter of lien realease to the onwer (not you).. It is then his responsibility to provide that to you in order to complete the sale.

    I have the title and it shows that HSBC is a lien holder on it. The clerks office requires that the finance company fill out a form of lien release and send it directly to them. That is what I am having trouble getting. I have the sellers contact information and have made several calls and am getting no response. I am taking it all to my attorney next week to see what he recommends doing.

    I'd recommend that. They won't send the lien release to you because you are not the owner. The person you purchased from is. If that person is not willing to fulfill his obligation in the matter then you more than likely need a lawyer.

    I have been trying for the past week to get in contact with the owner of the motorcycle and the person that they gave the title to that I actually gave the money for the motorcycle and they will not return any of my calls. I have a receipt stating that she took the money for the motorcycle and that the lien had been released. Do I have any chance of getting my money back if they do not want to cooperate or is there any way to get the lien released at the court house with out the finance company sending them a lien release. I have talked to the finance company and they said that the motorcycle has been paid off since 2005 but for some reason the ignore every request that has been made for a lien release to be sent the the courthouse.
