    Default Landlord Asking Tenant to Vacate for Time Period

    My question involves landlord-tenant law in the State of: CA

    I understand that the landlord legally is to notify the tenant 24 hours in advance that they will enter premises. But can they legally ask me to remove items and pets as well. They did give me from Saturday night at around 6PM till Monday at 10 AM to enter all of my cabinets and shelves in all bathrooms and the kitchen as they were planning on spraying for ants. But they also stated that the apartment must be vacated for up to 2 hours after the spraying. They are aware I have cats which would mean boarding for an entire day while I was at work. Also I did not request the pest control nor have problems in my apartment I have not been able to fix with Raid. Legally are they able to ask me to vacate with my pets for any time period?

    Basically, yes they may have that ability.

    They may be bound by city ordinance or state law that requires them to exterminate if a certain number of residents report problems, or if it's a periodic requirement for licensing.

    Again, state law or city ordinance might dictate, based on the chemicals used, that for the safety of all residents and their pets, a danger may exist for up to XX hours after spraying and that, during that time, no occupancy of the dwelling is allowed.

    It appears that they are taking precautions to protect their tenents, and themselves, from potential liabilities should a serious illness, or death, occur as a result of this action.

    You also may want to read your lease agreement. There may be a stipulation there that indicates such. If not, you may wish to inquire as to reimbursement/compensation should you have to take up temporary residence in a hotel.
